SPCA (Society for
Prevention of Cruelty to Animals): An Animal Welfare Organizations
As a unit, Non-Governmental Organizations (NGOs) can’t

The SPCA’s Mission

Examine and deal
with objections of unkindness and negligence.
2. Support the rules linking
to the treatment of animals and take actions where required.
3.
Give sanctuary to
animals in distress.
4.
Rehome suitable
animals where possible.
5.
Provide medical
aid to animals in need.
6.
Assist with public
education.
7.
Promote
responsible pet ownership.
Roles
and responsibilities of SPCA
1. The primary
function of the SPCA is to help the state government, the Animal Welfare Board
of India and local authorities such as municipal board, State Animal Welfare
Board, Region panel or any local animal welfare association approved by any law
in implementing the requirements of The Prevention of Cruelty to Animals Act,
1960.

The SPCAs are also
authorized under the rules to make bye-laws and guidelines as and when required
for the efficient discharge of their duties and to contribute to the animal
welfare of the relevant district.

The SPCA has been
authorized to search and seize any animal from any person who has committed an
offence under the Prevention of Cruelty to Animals Act, 1960. It can also permit
a person to do the equivalent work on its behalf.
4.
The SPCAs are
supposed to construct animal shelters and infirmaries to protect and treat the
animals who are victims of cruelty, for which the state government has to
provide all the facilities including land and finance.
5.
It is the duty of
the SPCA to supervise the functioning of all the animal shelters and
infirmaries in its area, including the ones which were already existing when
the guidelines came into power, and further, to employ a manager, a full-time
veterinarian and other staff necessary for the appropriate function of the SPCAs.
Formation
and regulation of SPCAs rules, 2001
In application of the authorities discussed
by the PCA Act, 1960, the Central Government informed the ‘PCA (Establishment
and Regulation of SPCA) Rules, 2001’.

Definitions
Act: PCA Act, 1960.
Animal Welfare
Organization (AWO): A Welfare
Organization for animals which is registered under the Societies Registration
Act of 1860 or any other corresponding law for the time being in force and acknowledged
by the AWBI or the Central Government of India.
Board: Animal Welfare Board of India (AWBI).
Local Authority: A municipal board of municipal committee, a State Animal
Welfare Board, district board or any local AWO authorized by any law for the
control and administration of any problem linking to animals within a definite native
area.
Society: SPCA recognized in any district under the Societies Registration
Act, 1860 or any other conforming regulation valid in a state and shall comprise
the current SPCA operative in any region.
Veterinary Doctor: A person registered with the Veterinary Council of India
established under the Indian Veterinary Council Act, 1984.

SPCA in a District
A.
The Managing
Committee of the Society consisting of a Chairperson and other members as may
be considered necessary by the State Government or the local authority of the district
subject to the condition that -
i. At least two
members shall be legislatures of the AWOs which are aggressively involved in
the work of PCA and welfare of animals mainly from in the region.
ii. At least two
members shall be the persons designated by the board of members of the Society.
B.
The duties and
powers of the Society shall be to aid the Government, the Board and local
authority in enforcing the provisions of the Act and to make such bye-rules and
strategies as it may believe essential for the competent release of its responsibilities.
C.
In addition to the
powers conferred by these rules, the State Government may, in consultation with
the Board, confer such other powers upon any Society for exercising the powers
and clearing the roles allocated to it under these guidelines.
3.
Setting up of Infirmaries and Animal Shelters
A.
Every State
Government shall provide adequate land and other facilities to the Society to
construct infirmaries and animal shelters.
B.
Every hospital and the animal shelter shall have –
i. a permanent
veterinary doctor and other staff for the real running and care of such hospital
or an animal shelter.
ii. a manager who
shall be selected by the Society.
C.
Every Society
shall, through its administrator or otherwise, supervise the overall
functioning of the infirmaries and animal shelters under its control and
jurisdiction.
D.
All cattle pounds
and pinjrapoles retained and run by a local expert shall be accomplished by
such expert equally with the SPCA or AWOs.
4.
Regulation of SPCAs
A.
Every Society
shall submit its annual report to the Board incorporating therein the
activities are undertaken by it for the welfare of animals and the steps or
measures are taken by it to apply several requirements of the Act and the instructions
made thereunder along with yearly accounts duly inspected by a chartered
accountant or any other body appointed by law in one month from the date of its
financial records having been finalised by its management board.
B. The Board shall examine such annual report and the annual accounts submitted by the society and may give any directions to it for improvement of its functioning including the supersession of the managing committee of the Society to give effect to the provisions of the Act and the Rules made thereunder.
